Secure My Pass HYBRID EXPERIENCE

Refunds & Revocation Policy

a. All Passes are the sole property of The Gathering. As always, if Participant violates these Terms, The Gathering has the right, in its sole discretion and at any time determined by The Gathering, to cancel, revoke, or refuse all transactions with any individual or entity, including, without limitation, the following: Passes, purchases, and/or hotel reservations made through The Gathering. The Gathering will not be responsible for any penalty, fee, loss, or expense incurred by Participant that might result from such action, regardless of whether such penalty, fee, loss or expense was foreseeable or The Gathering was advised of the same.

b. The Gathering does not issue refunds under any circumstances, including, without limitation, for Application fees or Passes purchases. Any and all payments made to The Gathering are not refundable for any reason, including, without limitation, failure or inability to use Passes due to illness, acts of God, public health crisis, government restrictions, travel-related problems, acts of terrorism, loss of employment and/or duplicate purchases. The Gathering will not issue refunds, deferrals or credits for Passes that have been revoked.

c. If an Event is cancelled in its entirety for any reason, you may defer your Passes to the next The Gathering Event of the same type for which your Passes were purchased. If an Event is cancelled in its entirety for any reason, you agree that aside from obtaining a deferral credit for your Passes, you will have no remedy against The Gathering, at law, in equity or otherwise, including, without limitation, for a refund of payments made, expenses incurred, or any actual, consequential, or punitive loss or damages of any kind, regardless of whether such loss or damage was foreseeable or The Gathering was advised of the same.

d. If an Event in its entirety is postponed for any reason, your Passes will be valid for the rescheduled dates in the same calendar year for such Event. If an Event in its entirety is postponed for any reason, you agree that aside from your Passes being valid for the rescheduled dates, you will have no remedy against The Gathering, at law, in equity or otherwise, including, without limitation, for a refund of payments made, expenses incurred, or any actual, consequential, or punitive loss or damages of any kind, regardless of whether such loss or damage was foreseeable or The Gathering was advised of the same.

e. Unused Passes have no monetary value and cannot be credited to future years or events unless the Event in its entirety is cancelled and you defer your Passes to the next Event.
f. The Gathering will not issue refunds or credits due to failure to redeem a discount coupon during the registration process.

g. Discounted Passes prices are based on the date payment is received in the The Gathering office.

h. Lost or stolen Passes will not be replaced. If Passes are lost or stolen, new Passes will need to be purchased at the full price in effect at that time for a Participant’s continued access to the Events, including, without limitation, showcases, parties and conference content.

i. Use of Passes by anyone other than the authorized individual will result in revocation of the Passes without a refund.

Passes Transfer Policy

The Gathering Passes are issued to, can be picked up by, and used only by the Participant named in the registration.

a. Up to twenty-eight (28) days prior to the start date of a Physical Event, The Gathering will accept a request to transfer Passes by submitting the Participant name to Alanna@cultgathering.com

b. Physical Event Passes are non-transferable after they have been picked up.

c. Passes may not be transferred and name changes will not be made after Passes have been issued.

d. Notwithstanding the provisions above, Summit Passes are non-transferrable.

Liability and Insurance

The Gathering Organizers cannot accept liability for personal accidents, and/or loss of and/or damage to private property of attendees, either during or directly arising from The Gathering 2022. Attendees shall have no claim against the Organizers in respect to any loss or damage arising from the postponement or cancellation of The Gathering 2022 due to happenings beyond the Organizer’s control. Participants shall have no claim against the Organizers in respect to any loss or damage arising from The Gathering Global virtual event network becoming wholly or partially unavailable throughout the duration of The Gathering 2022.

Force Majeure

The celebration of The Gathering 2022 shall be subject to Force Majeure, including, but not limited to, acts of God, fire, flood, natural disaster, war or threat of war, acts or threat of terrorism, civil disorder, strikes, inevitable accident, the non-availability of stable internet connection or any digital malfunction, governmental regulation or advisory, recognized health threats as determined by the World Health Organization or local government authority and health agencies (including, but not limited to, the health threats of COVID-19 or similar infectious diseases), curtailment of transportation facilities, closure of facilities, non-availability of the event premises, reduction of available personnel, limitation of events capacity or travel restrictions, or other similar occurrence beyond the control of the parties whereby any of those factors, circumstances, situations, or conditions prevent, dissuade, or delay a reasonable percentage of prospective event attendees from appearing at the event, or where any of them make it illegal, impossible, inadvisable, or commercially impracticable to hold the event or to fully perform the event as originally planned.

For any one or more of the above reasons, the event may be modified, cancelled, abandoned, suspended in whole or in part, or transformed into a different format by the Organizer, without any liability, damages, fees, or penalty. In these cases, the Organizer may at its entire discretion repay the relevant fee paid by the attendees, or part thereof, but shall be under no obligation to repay the whole or part of such amount, and shall be under no liability to the attendees in respect to any actions, claims, or losses which may be incurred by the attendees, as a result of any such event.
